@ guitarman35: The writer of the song did. You can play this without a capo but you have to adjust the chords on your own.

For an alternative you can check out a great live version on Radney Foster's "Unplugged at Studio 330." Kieth Urban has such a stamp on this song that by going back to the writer's version you can put own stamp on it.
