I'm a member of BMI (it's better than ACSCAP), and you need to be compensated. I would start by finding an entertainment lawyer in your area..
I had a band record two of my songs in 2005, the songs were written in 1998, but the band had been playing 5 of my songs in their gigs. At first it's an honor and humbling sentiment, but once they recorded the two songs on their CD. It just pissed me off considering that the leader NEVER asked for perminssion, lied about the number of copies they pressed. And one of my songs was the opener on the Album and was the only tune that got radio play. My lawyer said that his lawyer had to disclose all info, and the CD didn't sell very well at all, and since I had both songs copyrighted since I originally wrote them in '96 and landed on my CD in '98, and knowing he didn't sell but roughly 1500 copies, my lawyer said we'll get 22 cents per album which didn't add up to quite $400 USD, So we sold him the rights to use the songs, (not to own them or the copyrights) for $1200 USD apiece, ao I got $2500 USD after "predicting" how much more he would sell and paying the lawyer. (whose worked with me & my bands for years with studio deals, festivals, etc.) A great entertainment lawyer that knows his shit is priceless!!
